Our Federal Government client is seeking to engage an Independent Reviewer on a contract until February 2022 with a potential extension of 1 X 3 months.

About the Role:

Our Client is seeking one or more suitably qualified and experienced consultant(s) to undertake a review and assessment of the OoE's use of LSPs under the current WoAG Legal Service Panel and ongoing legacy arrangements in the environment of the Commonwealth procurement framework.

Duties & Responsibilities:

The review and assessment will focus on identifying opportunities for efficiency, streamlining of existing governance and management processes, and increased effectiveness which may include but not be limited to:

  • governance arrangements;
  • roles and responsibilities;
  • engagement and onboarding processes and procedures;
  • panel management;
  • order management;
  • performance management of LSPs (including KPIs);
  • initial and ongoing value for money assessment;
  • cost controls such as initial and foreseeable estimates received from LSPs; and
  • internal reporting including LSP spend and management;
  • cost benefit analysis as compared to internally resourced matters; and
  • business reference material.

The OoE's use of LSPs has increased significantly in the last three years and it is now appropriate for ASIC to evaluate whether we have the optimal governance, systems, processes and resources for our procurement and onboarding, contract and performance management, and reporting on these services.

We have commenced the Optimisation of External Legal Resources Project (OELR Project), the objectives of which are:

  • evaluate how we can best improve and optimise the OoE's use of LSPs with a focus on efficiency, effectiveness, value for money and appropriate performance oversight, reporting and cost controls;
  • identify ways to accelerate the time taken to on-board the LSPs;
  • develop a performance management framework for our oversight of LSPs;
  • develop enhanced reporting on our retainer of LSPs on a matter by matter basis;
  • develop a tracking and analysis tool for assessing the costs and benefits of the use of LSPs to assist our work;
  • make recommendations to the OoE Executives on any required changes to our current systems, processes and resources for managing our external legal spend; and
  • develop a more comprehensive step by step guide/manual for our staff for managing LSPs.

Mandatory Requirements:

  • The successful candidate will be required to have a Baseline security clearance.
